论未成年人犯罪社区矫正制度的建构——以地震灾区四川省绵阳市为例

社区矫正是在行刑社会化背景下应运而生的一种刑罚执行制度．符合国际行刑趋势。未成年人犯罪有不断上升的趋势．呈现出财产型犯罪突出、暴力化犯罪程度加剧、犯罪人低龄化和文化水平低、共同犯罪居多等特点。重视未成年人的特殊性，在行刑社会化视野下、在犯罪要素的框架内，考虑建构有针对性的社区矫正制度．可以有效预防和控制未成年入犯罪行为的发生、更好地挽救改造未成年犯罪人．达到更好地保障未成年人权益的目的。
