黑社会性质组织辨析

黑社会性质组织作为有组织犯罪的一种形态,既不同于一般犯罪集团,也不同于典型的黑社会组织。应当在准确界定社会性质组织的概念和科学分析当前犯罪态势的基础上,重新审视其构成要件,划清与其他有组织犯罪形式之间的界限。在认定黑社会性质组织时,客观要件上应注意其行为的多样性和复杂性;主体要件上应注意其组织严密性和成员众多性,其构成人数至少应当3倍于一般犯罪集团成员底数;主观要件上应当引入犯罪人格的分析。在遏制黑社会性质组织犯罪的总体战略中,对其重点打击的“圈”不宜划得过大,“稳、准、狠”的方针中,关键在“准”。
