试论海岛开发利用与法制保障——以浙江省依法开发舟山群岛为例

中国是一个海洋大国,有300万平方公里的海域,有大小岛屿数以万计。近年来,国家经济快速发展,自然资源日益紧缺,海岛的重要性逐渐体现。如何科学开发利用海岛日渐成为一个越来越受到重视的议题。2009年12月26日,我国《海岛保护法》经全国人大表决通过,并于2010年3月1日起施行。《海岛保护法》是我国首次以立法的形式加强对海岛的保护与管理,规范海岛开发利用秩序。以浙江舟山群岛的发展为例,通过比较各地海岛开发利用的过程和经验,可以为我国海岛相关配套法律制度的制定和具体操作提供可行性建议,以期有助于我国海岛的科学合理开发利用,促进地方海岛经济的进一步发展。

On the Development and Utilization of Islands and the Legal Protection: Taking the Development of Zhoushan Islands as an Example

China is a large maritime country with 300 million square kilometers of sea area and there are tens of thousands of small islands.In recent years,the importance of the islands is standing out gradually with the country’s rapid economic development and natural resources becoming more and more short.The issue of scientifically developing and utilizing the islands is getting more and more attention.On December 26,2009,China’s "Island Protection Act" was enacted by the National People’s Congress and the Act came into force on March 1,2010.It is the first time that the country has,in the form of legislation,strengthened the protection and management of the islands,and regulated the order of utilizing the islands.The paper taking the development of Zhoushan Islands of Zhejiang as an example,by comparing the progress and experience of developing and utilizing islands in different areas,provides some feasibile recommendations to support the specific operating and the improvement of the legal system.The authors hope to contribute to the scientific and rational utilization of our slands,and promote the further development of the local island economy.
