试论中国特色国际经济法学派的形成及其代表性成果

国际经济法学是一门新兴的边缘性学科,长期以来,以美国为首的西方国家的权威学者对本学科的开拓和研究多有建树。其中的新鲜知识,值得学习。但是,其中的某些关键性学术观点,却弥漫着或残留着浓烈的殖民主义、扩张主义、霸权主义气息,流毒全球,损害广大发展中国家弱势群体的国际平权地位和合法权益。陈安教授立足于中国国情和第三世界国际弱势群体的共同立场,独立思考,长期致力于探索和开拓具有中国特色的国际经济法学,投身国际争鸣,提出诸多开创性的新见解,为中国和国际社会弱势群体"依法仗义执言",提供维护其应有平等权益的法学理论武器,积30年之功,荟萃而成五卷本《陈安论国际经济法学》(310万字)这部鸿篇力作。学界认为,这部力作具有鲜明的中国特色和很高的学术水平,堪称"独树中华一帜,跻身国际前驱",可谓"一剑淬砺三十年"。该书的出版,标志着具有鲜明中国特色的国际经济法学派的初步形成。本文対贯穿全书的陈安教授的基本学术思想、学术理念和学术追求,加以梳理、概括和评介。

Preliminary Comments on the Formation and Representative Achievements of IEL School with Chinese Characteristics

As a newly developed inter-marginal discipline,International Economic Law(IEL)has been,for a long period,under the sole exploitation and research by authoritative western scholars,particularly those from the United States.Fresh knowledge parts contained in their achievements are worth studying.However,a certain number of critical academic viewpoints contained therein permeate or remain a strong odor of colonialism,expansionism and hegemonism,which has been exerting a pernicious influence around the world,infringing and causing damage to the equal status and lawful rights of international weak groups.Based on the basic situations of China,and upholding the common stand of the third world,Prof.An CHEN develops an independent thought,and devotes himself to the exploration of an IEL School with Chinese characteristics.With a lot of creative and original viewpoints as theoretical weapons for China as well as other weak groups in international community to strive for and safeguard their proper and equal rights,Prof.An CHEN throws himself to various debates in international fora,stands on the side of justice and tells the truth.His efforts and achievements accumulated through thirty years have now been compiled and merged together into a masterpiece,namely,An CHEN on International Economic Law(Five Volumes),lengthy of approximately 3,100,000 words.The clear-cut Chinese characteristics are commonly recognized in this series of books,whose academic values are also highly appraised.This masterpiece,which signifies the initial formation of a new IEL School with Chinese Characteristics,could be said to "hoist a Chinese banner and pioneer in the international community".One may also well say that "it is through thirty years of severe trials before an excellent sword is finally casted".This Article endeavors to summarize and review Prof.An CHEN’s basic academic thoughts,ideas and pursuits which run through these five volumes.
