人民陪审员制度的反思及其可能的走向

现行的人民陪审员制度被赋予了司法民主的价值期盼,实践证明,法律赋予它的价值却没有很好的体现出来;制度本身与现行的诉讼实践和法律规定也多有矛盾之处。为此,应该在现有的社会背景下重新审视和变革人民陪审员制度。采取专家陪审与大众陪审相结合的方式完盖人民陪审员的选任及管理由当事人启动陪审程序重构陪审程序完善现行法律,明确陪审员的权利、义务和责任。

Reflect on People's Juror System and its Possible Trajectory

The current people＇s juror system was given an anticipation of judicial democracy, but practice proves that the value given by the law has not fully reflected; and there exists many inconsistencies within the current system itself and the present lawsuit practice and the legal provisions. Therefore, the people＇s jurgr system should be reviewed and reformed under the existing social background： combine experts jury with public jury, perfect the selection and management of people＇s jurors, and define the rights, obligations and responsibilities of the jurors.
