| 摘 要： | 刑法修正案（八）草案将有期徒刑上限提高，这一修改意见的提出具有其合理性与必要性。它不仅有利于缓解我国现行刑罚体系中的冲突与矛盾，也顺应了世界各国通过提高自由刑上限从而废除死刑的趋势，更是从我国目前人均寿命大幅提高的实际出发而提出来的。不过，刑法草案将有期徒刑数罪并罚年限提高到25年还是比较低，应将其提高到三十年。此外，为适应有期徒刑上限提高的现实需求，还应当完善我国的减刑、假释等制度。

| Abstract: | It is very rational and necessary for the draft of Criminal law amendment （8） to raise the imprisonment limit. It not only can reduce the conflict and contradiction in the current punishment system, it complies with the trend of countries all over the world by raising the limit of freedom penalty so as to abolish the death penalty, it is also put forward from the reality of our country that the llfe expectancy at present is on the increase. However, the criminal law draft raised the combined punishment for several crimes to 25 years which is comparatively low and should be increased to 30 years. In addition, in order to adapt to the demand of raising the imprisonment limit, we should improve China＇s commutation and parole system. |
