检察监督视野下行政执法与刑事司法衔接中的问题及其完善

我国的行政执法与刑事司法衔接机制在立法上、制度建设上和实施过程中均存在着一系列问题,特别是检察机关无法对行政执法机关＂不移送＂情形实施法律监督,影响了衔接机制的顺畅运行。因此突破检察机关在衔接机制中履行法律监督的法理障碍,对＂行刑衔接＂机制在立法上予以完善,并建立健全行刑衔接的检察监督机制和相关的制度平台实属必要。

Problems in the Coordination Mechanism of Administrative Penalty and Criminal Jurisdiction and its Countermeasures

There is a series of problems in the coordination mechanism of administrative penalty and criminal jurisdiction,especially the procuratorial organs cannot supervise the administrative law enforcement agencies for ＂not removing the case＂,which affected the smooth operation of legal coordination mechanism.This paper,with an analysis of the separation of administrative penalty and criminal jurisdiction in present China,proposes that administrative penalty and criminal jurisdiction be well-coordinated in judicial practice.
