激活死刑赦免制度的可行性分析

建国六十多年来,我国的刑事法治建设取得了重大发展。针对我国死刑适用现状,通过综合路径限制死刑是我们的必然选择。我国宪法中规定的赦免制度在刑法视野下具有多种价值,但由于多种原因,该制度在实践中却被虚置。我们应该尽快激活该制度,在此基础上,逐步明确其适用的对象、条件和程序,打消民众顾虑,推动赦免制度的法典化,最终促进刑事法治进步。

Research on the Amnesty System to the Death Penalty

Since the founding of Peopl＇s Republic of China,Chinese criminal law has made significant development.Limiting the death penalty is an inevitable choice in our country.The amnesty system to the death penalty has several values,but because of various reasons,the system has been invalid in practice.Activating this system is vital in limiting the death penalty.In order to promote criminal progress in the rule of law,we should improve the amnesty system,define the objects,the conditions and the procedures of its application.
