| 摘 要： | 在法律实证主义内部,各个时期代表人物的理论有所不同,奥斯丁和凯尔森关于法与国家关系的理论就不尽一致。由于哲学基础的不同、理论体系逻辑起点的不同以及理论追求的不同,奥斯的和凯尔森在论述法与国家的关系问题上就表现出了差异,厘清这些差异有助于深化我们对于法律实证主义的理解。

| Abstract: | The theories of the representative figures of legal positivism in different periods are not the same.On the issue of the relationship between law and nation,Austin and Kelsen have different theories.Because of different philosophical foundations,different logic starting point and different goals of theory,Austin and Kelsen hold different opions on the relationship between law and nation.Clarify these differences will help deepen our understanding of legal positivism. |
