权利本位研究范式在现代警务中的价值

回应发展变化的社会现实,推动警务行为现代化的发展,首先面临的应是观念上的革新,即由义务本位范式向权利本位范式转变。权利本位研究范式在现代警务中的价值着重体现在重构警察权力与公民关系、树立以“相对人为中心”的执法理念、扩大相对人的参与,批判和否定义务本位范式,把警察权力与公民权利的关系建立在民主、科学、理性的基础上,克服行政执法的官本位,树立民本住和服务观念,进而有助于实现公民与警察之间的良性互动。

The value of right-standard paradigm in modern police affairs

To respond to the changing social reality and promote the development of the modernization of police affairs, what a policeman should do first is to reform the concept, that is to transform the traditional duty-standard paradigm into the modern right-standard one. Its value lies on the aspects of rebuilding the relationship between police's power and citizen's right, setting up the concept of being oriented by the need of citizens, expanding the participation of the citizens in public managements and animadverting and negating the duty-standard paradigm. Establish the relationship between power and right on the basis of democracy, science and rationality, conquer the officialstandard in executing the law and build up the citizen-standard and service concept. And it is also helpful to have a mutual beneficial relationship between police and citizen.
