审查起诉阶段口供采信中的问题与对策

在审查起诉阶段,检察人员常常会遇到诸如口供前后不一致,同案人口供,以及只有口供而无其他证据证明的事实等等情况。应当赋予口供多强的证明力、单独口供能否被采信,等等问题是检察人员必须面对和判断的。口供应当具有完整、独立的证据价值。我们不能因为对刑讯逼供的憎恶和恐惧,就否定口供的独立性和贬低其证明价值。我们也应当认识到单个(口供)证据的价值,特别是在证明案件事实某一方面的(充分)证明作用。

The Problems and Countermeasures of Confessions in the Stage of Review and Prosecution

In the stage of review and prosecution, some problems such as the latter confession is different from before, the confessions of codefendants, some facts can only be confirmed by confessions, and so on, often are encountered and judged by prosecutors. The confession should have probative value completely and independent- ly. We can＇t deny the value and dispraise the probative value of confession because of the abomination and fear of torture. We should realize the value of single evidence, especially in proving the fact of case in some asoect.
