| 摘 要： | 在查办商业贿赂犯罪案件过程中,一些执法人员对于诸如贿赂的界定、回扣的认定、商业受贿罪的主体、“为他人谋取利益”的含义等法律适用和法律程序上的问题还存在模糊认识,研究探讨这些问题对于查办商业贿赂案件无疑具有重要的参考价值。
