我国亲权制度构建的理论思考

亲权是父母基于其身份所有的权利义务,它以保护教养未成年子女为目的,是父母子女权利义务关系中的核心内容。现代社会中的亲权,不仅是一项权利,也是一项义务。亲权制度在很多国家的立法中都有体现,它是区别于监护的一种有存在价值的制度。在我国当代法律、法规中,对亲权的概念未与采纳,也没有完备的亲权制度,但可以找到亲权理论的相关内容。本文拟从理论层面阐释对此问题的思考,以期对我国亲权制度构建有所启示。
