2018年以来地方市场监管机构改革之探——以云南省Y市为例

2018年3月,《深化党和国家机构改革方案》发布,拉开了新一轮机构改革的帷幕。作为改善营商环境的重要抓手,市场监管体制改革也全面展开,并向地方改革的纵深推进。改革以来,地方监管任务增多但监管资源保障不足,监管专业化趋势强但基层监管能力不配套,监管责权一致的要求与监管部门职责不明依然有矛盾,监管的优化服务需求高但监管服务品质不够,监管更需要协同共治但监管力量依然分散,地方复制中央机构设置但编制、资源、能力无法与之相匹配。地方监管体制改革,要以监管功能为导向,条块协同为方法,加强新时代监管人员的能力建设和组织学习,打造灵活有力、目标清楚、多级、多元参与的监管模式,实现监管的共治共享格局。

A Probe into the Reform of Local Market Regulator since 2018--A Case Study of Y City in Yunnan Province

In March 2018,The Plan for Deepening the Reform of Party and State Institutions was released,marking the beginning of a new round of institutional reform.As an important way to improve the business environment,reform of the market regulatory system has been carried out in an all-round way and guided towards local reform.This paper examines the process of market regulatory system reform(including experience,issues,challenges,and future path)in China by taking Y City in Yunan Province as an example.The study indicates that,since the reform took place,the local regulation tasks increased,yet relevant resources are in short supply;the professional nature of regulation is strengthened,yet the capacity at grass-root level is not sufficient.The consistency requirement of obligations and authority is in conflict with the lack of responsibility definition.The optimization service demand is high,yet the quality is relatively low.Regulation requires coordinated action,yet the efforts are scattered.The local institutions try to copy the central government,yet they fall behind in organization,resources,and capability.The reform of local regulation system shall follow the direction of regulatory function,and take the method of cross-departmental coordination.We should strengthen capacity building and organize learning for the regulators in the new era,so as to build a regulatory mode featuring flexibility,energy,clearly-defined objectives,multi-layered management,and pluralism in participation.An all-in and all-win pattern of regulation can be achieved thereby.
