国家恐怖主义与国家刑事责任

国家的刑事责任长期以来都是各国政府和国际法学者争议且没有定论的问题。虽然国家的国际刑事责任在国际法上还没有充分的依据,但不能因此否定国家刑事责任的存在。自二战以来,国际社会已经有对犯有国际罪行的国家予以制裁的实践,但这些实践并未最终促成国际社会在国际法上制订出相应的追究国家刑事责任的法律,因此,对于如何追究国家的国际刑事责任并没有具体的法律依据。本文从国家恐怖主义的角度论证国家应该承担国际刑事责任的必要性,从一个新的方面来探讨从立法上追究国家刑事责任的可行性。

On the State's Criminal Responsibility in the View of State Terrorism

The criminal responsibility of state is a long-contested and unsettled issue among states and scholars.Though there are practices of sanction to a state with international crime,these practices don't promote the international society to codify any correspoding laws.This article tries to discuss the necessity and feasibility of the state's criminal responsibility and the modern general practices in the international society.
