论无民事诉讼行为能力人的自认——兼论《关于民事诉讼证据的若干规定》第8条

2002年4月1日最高人民法院颁布的<关于民事诉讼证据的若干规定>正式施行.该规定的第8条对民事诉讼中自认的效力进行了规定,但未对无民事诉讼行为能力人的自认的效力作出明确规定.本文从自认在民事诉讼证据中的地位出发,分析了无民事诉讼行为能力人自认所涉及的法律问题,针对我国现行的法律规定提出了建议.

Admissions of Incompetent Person in the Common Pleas--An analysis of No.8 of Evidentiary Rules in Common Pleas

Evidentiary Rules in Common Pleas enacted by the Supreme Courts has been carried into execution on April 1st, 2002. Although the efficacity of admission in the common pleas is prescribed by NO.8 of the rules, there is no any rules which is prescribed about the efficacity of admission of incompetent person. The present paper, based on a thorough study the status of admission in evidentiary rules in the common pleas, analyses some law issues about admissions of incompetent person and tables some attempted measures that the author believes may contribute to the solution of the problem.
