| 摘 要： | 法官责任豁免制度起源于西方国家，对维护司法的独立与公正发挥了十分重要的作用。设立法官责任豁免制度具有充分的理论依据。法官法和最高人民法院的相关规定仅赋予法官一定范围内的责任豁免权，但实践中亦难于实行。在我国建立完善的法官责任豁免制度不仅必要而且可行，为此应当在法官法中明确规定法官责任豁免权及其界限，并废除错案追究制度。

| Abstract: | the system of judge exemption of responsibility tracks to west countries and plays a crucial role in the protection of judicial independence and just. There are abundant basis to establish the system in China. The law of judge and the relevant regulations of the High Court invest the right of immunity to judge to some degree. However it is very difficult to realize it in reality. Nowadays it is necessary and practical to establish this system, therefore, we should clarify the fight and limit of judge＇ exemption, but abolish the accountability system for misjudged case at the same time in China. |
