| 摘 要： | 市场制假售假活动猖獗,假冒伪劣行为泛滥,具有国家强制力的法律应规制此种现象。在法律制度设计中,建议根据我国的实际情况,引入英美法系的惩罚性损害赔偿法律制度,完善规制假冒伪劣行为的法律制度。

| Abstract: | The legal stipulations of the law must cover the phenomena of making and selling counterfeit commodities. The author suggests that in the design of such a legal system the British-American law of exemplary damages be introduced in order to improve China' s law concerning punishing the making and selling of counterfeit goods. |
