古今廉政法律制度的比较和借鉴

中国古代虽未建立健全现代意义上的一套完善的廉政法律制度 ,但其建立的十分完善的官僚制度中将治吏放在极其重要的位置并积累了丰富的吏治经验 ,主要表现在官吏的选举任用、考核管理、监察监督、惩贪肃贿等法律规范及一些行之有效的制度之中。当代中国廉政法制建设的任务十分急迫且繁重 ,其中“依法治官”应当说是重中之重。文中围绕官员选任、考核、监察、惩贪四个方面的廉政法制建设进行了古今的比较研究 ,对借鉴古代廉政法律制度的精华为今日所用将是十分有意义的

Reflection on the Contrast between the Ancient and Contemporary Legal System for Building a Legal and Honest Government

The ancient China did not formulate a comprehensive legal system for clean administration viewed in a modern perspective.However,it is noteworthy that an ancient official was held in a vital position in its administrative system.A set of effective regulations were formulated in the rich experience accumulated in the process of selecting and assessing prospective officials,managing and supervising them when they took their office,as well as in their combat against corruption and bribe. At present,to maintain clean and honest administration is an urgent task for China.Especially,to manage officials with the law in mind is predominantly important.This paper contrasts the ancient society with contemporary China in terms of the construction of clean and honest administration from the following aspects: selecting officials,assessing their performance,supervision and punishment due to their corruption. From this comparative study,some useful lessons might spring.
