古典契约论思想及其评介

契约论思想发展的第二阶段是古典契约论时期，其内部又包括三个发展阶段：第一阶段的纯粹自然理性学说以格老修斯等为代表；第二阶段的社会分权和自由学说以洛克等为代表；第三阶段的价值学说以卢梭和康德为代表。契约论的很多学说虽然缺乏实证、仅为理论假设，但追求平等、自愿和互利的原则却扩展到全球，得到世界认同。

On Thought of Classic Theory of Contract and Its Review

The period of classic theory of contract is the second stage of the thought of contract theory, including the three stages： 1. doctrine of pure and natural reason taking Glorious as the representative; 2. doctrine of social decentralization and freedom taking Locke as the representative; 3. doctrine of value taking Rousseau and Kant as the representative. Some doctrines in the Contract theory are only theoretic hypothesis without empirical study. However, the principles of pursuit of equality, voluntariness and mutual benefit expand the global and obtain world identity.
