非法持有、私藏枪支、弹药罪的规范缺陷与完善

持有行为包括了私藏行为，二者不是并列关系而是种属关系，非法私藏行为不能归于非法私藏枪支、弹药罪，应当归属于非法持有枪支、弹药罪，因此，立法中应当将“私藏”的表述删除。非法持有爆炸物的行为具有严重的社会危害性，理应犯罪化。这种行为不符合非法储存爆炸物罪的犯罪构成，而与非法持有弹药罪具有相同的性质，应当属于持有型犯罪，立法中应当将爆炸物列入非法持有的犯罪对象。刑法中区分弹药与爆炸物没有实际意义，应当采用广义的弹药概念，将爆炸物归属于弹药含义之中。
