论行政指导的救济与责任

本文通过分析行政指导在实践中存在的合法性问题 ,论述了构建行政指导救济和责任制度的重要性和必要性。并通过行政指导的性质、违法的行政指导与相对人损害之间的因果联系、信赖利益保护原则等角度论证了其理论依据。最后 ,提出了完善行政指导救济和责任制度的初步设想。

On the Remedy and Liability of Administrative Guidance

This thesis analyzes the legitimacy problems existing in the practice of administrative guidance, expounds the importance and necessity of the construction of the system of administrative guidance's remedy and liability and its theoretical basis from angles of the nature of administrative guidance, the causality between illegal administrative guidance and impairment of counterpart, and the principle of reliance interest protection. Finally it proposes tentative idea of the perfection of the system of administrative guidance's remedy and liability.
