占有、占有制度及其功能

占有是民法上的重要内容,事实上的占有起源于原始社会末期,法律上的占有起源于罗马法与日耳曼法。在性质上,占有泛指为占有状态、占有权、占有权能,各司其职。在成就条件上占有之内在成就需体素与心素,占有之外在认定仅需体素即可。占有制度以占有状态的法律肯认为基点呈不断扩张之势。占有在人类人文社会及经济世界都起了奠基性的作用,并且在法律制度构建中的功劳也是不可磨灭的。然而,占有在整个民法体系中常被忽略,由此导致整个占有制度极不完善,导致占有制度的功能不能全面发挥。
