| 摘 要： | 民事义务的存在是构成民事责任的前提。本文从侵权行为法的视角,结合法定义务是否来源于制定法的情形,展开论述了医师制定法上的义务和注意义务及两者相应的判断标准,并以个案的评价作为结语。

| Abstract: | The existence of someone's legally recognized duty is a premise to his civil liability in a civil case. Based on the theory of torts, the author analysed the scope of a doctor's legally recognized duty in his/her practice. Also, the author probed the standard of duty according to whether it is from statute or not. |
