论反致制度及我国的立法选择

反致作为国际私法独有的制度历来是引起各国专家学者广泛争论的问题。本文以反致制度在当今各国立法中的运用作为基点,通过分析反致在传统和现代国际私法中存在的价值基础,对反致制度进行再思考,认为在当今越来越多国家接受反致制度的背景下,应结合我国具体国情有限度地接纳反致制度。

Renvoi System and Legislative Options of Our Country

As a special theory in private international law,Renvoi has always been a controversial issue among scholars of different countries.Based on the application of renvoi system in current stipulations of different countries,this article makes an analysis of the value basis of renvoi existing in traditional and modern approaches to private international law,reconsiders the system and holds that renvoi should be adopted to a limit in China according to our actual situation,now that more and more countries are adopting it.
