印度尼西亚石油分成合同管理条款的形成和效果浅析

印度尼西亚独立后,开始推行石油分成合同制度,在现代石油开采合同机制中,形成了异于传统特许制的新合同关系,其突出变化在于改变由外企完全控制经营的局面。规定特许制度所没有的管理条款,强调东道国介入石油运营管理,国际石油公司不再垄断石油开发企业的经营管理权。但在外国石油企业依然具有技术和管理优势的情况下,管理条款的实际效果究竟如何,有待分析。

The Formation of Management Clause in Indonesian Production Sharing Contract and Its Effect

After independence, Indonesia advanced the system of production sharing contracts in its petroleum indus- try. This new system thus became something unprecedented by its innovative management clause, which was aimed at shift- ing power imbalance in the relation between host country and foreign oil company by strengthening former＇ s involvement in petroleum operation. However in view of technical and managerial inferior of Indonesian national oil sector, thus whether the change was a symbolic measure without substantive outcome requires further observation.
