| 摘 要： | 97新刑法修订中关于妨害国（边）境管理罪名的设置在罪名的补充和在刑罚的力度上都有所加强。然而，对于三罪之间的关系没有能够作出立法上的厘定。廓清三者之间的界限，在办案实践中具有一定的作用和意义。

However, the relationship between the three crimes did not make a legislative determination. This article attempts to clarify the boundaries between the three by a case. |
