论公司法人产权与国有企业改革

本文通过对产权问题的分析论证 ,指出产权是一个上位的概念 ,所有权是它的表现形式之一 ,资源的稀缺性引起的供求关系紧张状态导致了产权显示出独立于所有权的价值 ,在市场经济条件下与法人制度结合形成新的权利类型——公司法人产权 ,并结合国有企业改革 ,分析关于“法人财产权”学说的不足 ,探讨了确认公司法人产权对国有企业改革的意义。

On Legal Person's Property Right of A Corporation and the Reform of State-owned Enterprises

By analyzing the property rights, the thesis indicates that it is a superior concept and the ownership is one of its expressions. The tense relationship between supply and demand caused by the rareness of resources results in the independent value of property rights against the ownership, which forms legal person's property right of a corporation as a new right type in the market economy by combining with the system of legal person. With the reform of state owned enterprises, the thesis makes research to the defects in the theory of "legal person's property right" and discusses the meaningfulness of affirmation of legal person's property right of a corporation to the reform of state owned enterprises.
