| 摘 要： | 西方形式主义司法有其独特的文化成因，根源于实证主义法学，判例法、法典化及司法的困难促进了司法的形式主义。中外形式主义司法在解决纠纷中有着不同的作用机理，西方的形式主义对我国司法的改造有重大启示。

| Abstract: | The judicial tradition of dispute resolution in western countries evolved on unique cultural background, and originated from the positivist jurisprudence. Precedent law, codification and judicial difficulties promoted the formalism of justice .The dispute solution mechanism of judicial formalism in western countries is different from that in China, and it will bring about some significant enlightenment to the judicial reform of our country. |
