| 摘 要： | 2001年中国证券市场先后出现了“银广夏”、“麦科特”、“中科创”等一系列欺诈案件,引起股市的巨大动荡。接连出现的这几个大案都表明证券欺诈犯罪已经以更新的特点出现在刑法领域中,对此我们不能不予以密切关注。以麦科特欺诈上市案为例,分析证券发行阶段的欺诈行为的骗局要素、骗局特征和骗局类型,可以增强对这类欺诈案件的骗局机理的理解,把握其中的规律,并进而提出立法和司法的相关对策。

| Abstract: | The most serious cheating cases in stock mark et was disclosed in2001,such as MACAT,YIN GUANG XIA and so on.All these cases ha ve suggested the crime of cheating in stock market have more new characters that we should bring attention to.This paper analyzes the factors in the swindle so as to strengthen the understanding of the reasons and rules in these cases,and t hen give some ad-vice to judicial practice. |
