争议与选择：物权变动模式焦点问题透析

不同物权变动模式有两个争议焦点:登记和交付的法律效力,物权行为的独立性和无因性。对于前者,应廓清债权效力与公平所为的界限,在不动产登记中统一适用物权变动生效主义模式;对于后者,有必要采纳物权行为理论,不能把创设物权的契约归纳为债法上的合同行为,用债法合同规范予以调整。同时应使物权行为无因性和所有权绝对之间达到一个平衡,使所有人的利益与第三人的利益达到平衡。
