魏晋律令分野的几个问题

中国古代法在魏晋时期实现了律和令两种法律形式的分野。魏晋律令分野是秦汉国家各方面制度渐趋成熟的反映 ,是汉代律令不断向规范化、系统化发展的结果 ,也是西汉以来儒法合流、律学发达的结果。改朝换代也推动了律令分野的最终完成。魏晋律令分野标志着中国律令法体系的形成 ,对于深入认识中华法系的特征有着重要的意义。

Some Issues about the Distinction of Lv and Ling in Wei-Jin Dynasty

The period of Wei-Jin is an important developing stage of the Chinese Lv-Ling legal system. In the period, Chinese ancient law realized the distinction of Lv and Ling, which reflects the gradual maturity of all the related institutions in Qin-Han period. It is a result of the standardization and systematization of Han Dynasty''s Lv and Ling, as well as a result of the combination of Confucianism and Legalism. The dynastic change also promotes the completion of the distinction of Lv and Ling. This distinction not only marks the formation of Chinese Lv-Ling legal system but also made Lv become the proper name of Chinese criminal law, thus bearing significance in the understanding of the characteristics of the Chinese legal family.
