论民族经济法范畴的逻辑演进

本文从对民族在市民社会和政治国家二元结构中的地位的考察中确立了民族范畴 ,从对民族共同体发展的经济动因的分析中确立了民族经济范畴 ,从而为民族经济法范畴的确立提供了基础。文章认为 ,作为调整民族经济关系的法律规范总和的民族经济法并不是凭空产生的 ,它是民族 (包括现代的民族地区 )这一主体社会经济生活的客观要求 ,这种法的关系是由它所表现的民族经济关系的内容所决定的。民族经济法范畴的确立将使得民族经济法的研究成为经济法研究的重要组成部分 ,是经济法理论全面革新的必由之路。

The Logical Evolution of Category of National Economic Law

With the study on the position of nationality in the dualistic structure of the citizen society and political state, the thesis defines the category of the nationality, and defines the national economy with the analysis on economic reason of the national development as well. The thesis thinks the national economy law is the result of the nationality and decided by the content of national economy.
