自由贸易区的法律思考:模式、依据及框架

自由贸易区有单边及双边或多边两种模式,而双边或多边自由贸易区在理论上又可分为一般意义的双边或多边自由贸易区及次级双边或多边自由贸易区两种。就国际经贸规则而言,建立单边自由贸易区及双边或多边自由贸易区的法律依据不仅充分而且成熟,但在次级双边或多边自由贸易区的合法性问题上,则存在较大争议。此外,为因应当前经济全球化浪潮汹涌的新形势,借鉴其他国家及地区的经验,构建完善的单边自由贸易区法律应是值得探讨的问题。

Legal Thoughts on Free-Trade Area:Mode,Foundation and Structure

Generally, there are two modes for Free-Trade Area, one is unilateral, the other is bilateral, or multilateral. However, theoretically, Bilateral or Multilateral Free-Trade Area may be defined as two types, Common-bilateral or Common-multilateral Free-Trade Area, and Sub-bilateral or Sub-multilateral Free-Trade Area. For the international economic trade rules, the legal foundation is sufficient and mature enough to build up a Unilateral Free-Trade Zone and a Bilateral or Multilateral Free-Trade Area. Nevertheless, there is too much debate around the validity of Sub-bilateral or Sub-multilateral Free-Trade Area. Moreover, with the rapid development of economy globalization currently and the reference of the experience of other countries or areas, it has come to be a valuable argumentation to establish a complete legal structure for the Unilateral Free-Trade Zone.
