高校管理规章的法律思考

高等院校与其学生之间存在多重法律关系,高校通过制定和实施规章对学生进行管理是其行政职权的体现。高校规章作为一种有约束力的社会规范,应当合法、客观,体现正当程序,并接受来自行政、司法机关的法律审查,从而在依法治校中发挥积极作用。

Legal Reflection about the regulations of the university management

There are multiple legal relationships between the colleges and their students.It is the embodiment of the colleges' administrative power that the colleges supervise their students through establishing and executing rules.As rules with sanction,the college rules must be legal,impersonal and accordant with legal procedures.What's more,they must be examined by the administrations and the judicial apparatus so that they may exert a positive influence during the course of supervising the colleges according to the rules of law.
