论死刑除刑情节的内容及其逻辑位置

我国实施宽严相济的刑事政策，在死刑方面采取保留死刑，但严格限制死刑的态度。限制死刑的措施之一就是通过情节来限定，文中从应然与实然两个方面分析了中国今天的死刑除刑情节，并在此基础上进行分类整合，并根据当前死刑除刑情节的适用无统一标准的问题，总结出死刑除刑情节在量刑体系中的逻辑位置，构思了四分法的情节适用结构。
