| 摘 要： | 由航班延误引发航空运输承运人及其代理人与旅客、托运人之间的纠纷愈演愈烈。国内各大机场都出现了乘客在遇到航班延误后要求高额赔偿、占机等过激行为,导致航空公司声誉受损、社会影响不佳。因航班延误导致的诉讼也日益增多,现有的司法解决方法对纠纷解决显得捉襟见肘。示范诉讼以较小的诉讼规模解决因航班延误所引起的群体性纠纷中共通的事实或法律问题,为乘客提供正当有效的司法维权途径,并促使当事人在裁判外达成和解,有利于纠纷的妥当解决。

| Abstract: | Flight delays between the carriers and its passengers have caused many disputes. The passengers request big sum of compensation which the carriers could not meet. The behavior of the passengers are often not rational, and they could not find the proper procedure to protect their rights and interests. Flight delay disputes are increasing and we have to create new methods to resolve them. Test case is just the method we need. It could identify common facts and apply to laws and regulations uniformity in the group disputes by one case. |
