| 摘 要： | 证人免证特权制度的建立有其利弊。无论我国古代的法律制度还是世界上多数国家均规定有这项制度。出于“两利相较取其重,两害相较取其轻”的价值权衡,在我国刑事诉讼中建立证人免证制度,并结合我国的具体司法实践,去其弊、取其利,在追求法律公正的同时,维护社会的平衡和稳定。

| Abstract: | The system of witness' freedom from proof has its advangtages and disadvantages.Mangy countries in the world have this kind of legal system,so did Chinese ancient law.Comparing.with its advanttages and disadvantages,the author argue that it is necessary for our Criminal Procedure law to establish the system of witness freedom from proof.In order to maximize its advantagts and minimize the other side of it,we should combine this system with our judicial practice,only by this way,can we pursue the justic as well as the social stablity. |
