我国陪审员零陪审现象解析

零陪审现象是指新选任的人民陪审员从其担任陪审员之初至今一年多的时间里没有参与过任何形式的案件审理的情形.零陪审现象的成因与陪审员与法官对陪审制度的功能认识不足有关,但归根结底在于现有陪审法律制度及相关法律制度的缺失.这就要求摒弃陪审员精英化思想,扩大陪审员规模;着重陪审员道德及责任感培训而非法律培训;改参审为陪审,对陪审员职能重新定位;对陪审制度的法律规范细化,完善陪审员权利、责任保障和监督机制;完善诉讼法律相关规定,保障陪审制度贯彻实施.

The phenomena of non-assistance mean that an assessor hasn't taken part in any patterns' of assistance work in this whole year since the 'Decidesion' took effect.The cause of non-assistance relates to the assessors' and the judgers' wrong recognition of the assessor system's function.But the deep reason depends on the legal norms about assessor system and the law rules related to it.This needs:abandon the elite thought,enlarge the mode of assessors;Make emphases on training assessors' morality,responsibility and the feel of mission but not the training of law;Change an assessor into a juror,relocate the assessors' function;Stipulate the system in detail,make the principal of the assessors' rights and responsibility safeguard and surveillance mechanism perfect;Improve the action law's principal,ensure the assessor system to be put into effect.
