法律规范结构理论的批判与重构

长期以来，我国法学理论界对法律规范结构的学术观点主要有两种学说：“三要素说”和“两要素说”；虽然近有“新三要素说”对前二者提出了批判，但仍旧没有脱离传统的分析模式的缺陷：即将“存在论”的共时性结构分析转换为了“运行论”的历时性的操作分析。通过将结构界定为各要素的共时性存在，将法律规范结构重构为经由条件假定中介的调整性规则与管理性规则并立的条件性二元构造，较为合理地将法律规范的静态结构特质呈现出来。

The Critics and Reconstruction of the Theory of Legal Norm Structure

There are mainly two types of theories concerning the academic view of the legal norm structure in China's jurisprudential field for long,that is,the theory of three elements and that of two elements.Recently,there is a new theory of three elements initiating some critics over the former two theories,however,the new theory still has some defects such as without divorcing the traditional mode of analysis,i.e.,the synchronic structure analysis of the existence theory is trans- formed into diachronic operational analysis of the functioning theory.The legal norm structure is to be reconstructed via de- fining the structure as the synchronic existence of every elements and thus its static structure characteristics emerges.
