| 摘 要： | 目前人们对法院介入证券市场意义的认识 ,大都还停留在它能够使受害的投资者获得经济补偿上 ,对它所具有的证券监管方面的意义 ,认识得还不很充分。我们认为当前在我国证券市场的行政监管存在较为严重失灵的情况下 ,有必要在“纯行政监管”模式中引入法院监管 ,发挥其特有的功能 ,并对法院介入证券监管面临的问题提出解决的途径

| Abstract: | Currently, people's awareness on law court's intervening securities market remains on the economic compensation of the injured investor, however, it's significance on the securities supervision is ignored. The paper deals with the history and value function of the law court as judicial force, and suggests introducing law court supervision in the "pure administrative supervision" mode. The paper also advances several solutions to solve the problems concerning law court's intervening securities supervision. |
