红树林湿地地方立法保护探讨

红树林是热带海岸地带一种重要的湿地类型和重要的生态系统。转换性开发等人类干扰使分布在我国南方沿海省份的红树林湿地面积剧减。引起红树林湿地损害而得不到有力制止的原因之一是现有的环境立法对红树林的规定针对性不足 ,缺乏有力的法律保障。我们应当建立起以地方专门立法为主的法律规制机制 ,理顺土地权属关系 ,建立合理滩涂有偿使用机制、建立自然保护区 ,明晰违法责任等 ,最终实现对红树林湿地的有效保护

The discussion of the protection of the mangrove by local legislation

The mangrove is an important kind of the wetlands and ecosystems.While disturbed by human being's activities,such as convertible exploitation,the area of some provinces in southern China,where the mangrove distributed,had been decreased sharply.One of the most important reasons of the failure to stop the harm is that the environmental legislations in existence fall short of pertinence on the mangrove, which resulted in the lacking of efficient safeguard of the mangrove by law.We should establish the mechanism of legal regulation,which is mainly made by local government,to define the ownership of the land-use right,to fine the nature conservation area,to confirm the responsibility of the transgressor,and finally to achieve the target of efficient protection of the mangrove.
