| 摘 要： | 我国已经加入世贸组织,许多法律法规需要修改完善,《仲裁法》及仲裁规则也不例外,在全球化的背景下也要与WTO规则接轨。我国《仲裁法》在实施过程中,暴露出理论与实践中的一些问题,尤其对作为裁判者的仲裁员的规定过于简单。本文从仲裁员责任制度的必要性、有关仲裁员责任的诸家观点及立法建议等方面对仲裁员责任制度做了分析。

| Abstract: | China has entered WTO and some laws including the Arbitration Law of the PRC needs to be amended and improved. The liability of arbitrator provided for by the Arbitration Law of the PRC is very simple. Through discussing the necessity of the arbitrator's liability and scholars' viewpoints, this thesis thinks it is proper to amend some clauses of the Arbitration Law of the PRC and puts forward constructive articles to improve. |
