| 摘 要： | 《民办教育促进法(草案)》曾经在经过全国人大常委会连续三次审议后未能通过,向我们提出了一系列值得思考的重要问题:如何理解教育的性质?如何看待立法过程中的多数意见?如何看待立法的动机?如何看待立法过程中的修正案制度?如何妥善处理立法机关中统一审议机构与有关的专门委员会和其他工作机构之间的关系?认真研究和解决这些问题,对进一步完善我国的立法制度具有重要意义。

| Abstract: | Three times of continuous deliberation by the Standing Committee of the National People's Congress did not adopt the Draft Law of promotion of non-government run education. It raised a series of important questions for us to consider.How to understand the character of education? How to look on the majority opinion in legislation? How to look on the motivation of legislation?How to look on the bill of amendment system during legislation process? How to properly deal with the relationship of the United Deliberation Organ and relative Special Committee in the legislature with other functional Commissions?Carefully studying and resolving these questions is of great importance to the perfection of the legislative system in China. |
