| 摘 要： | 刑事裁判文书说理范式高级标准的主要：内容体现为两个针对，第一个针对刑事案件法律事实构建的本质和特点来说理，第二个针对对立双方在构建事实过程、适用法律认识过程中争议焦点的意见来说理。说理途径表现为塑造法官形象和体现司法公正。刑事裁判文书说理的内容、方法最终表现在制作模式上。因此，刑事裁判文书说理高级标准范式由此得出。

| Abstract: | The main content of the advanced standard foemat of criminal magistrate, instrument reasoning includes the followed two aspects： first, reasoning through essentiality and characteristic of legal fact structure of criminal case; second, reasoning thought opinion on the dispute focus during the two contrary parts＇ forming fact process and applying legal cognition process. The contents and ways of criminal magistrate instrument reasoning lastly appear in the format-manufacturing, so here comes the advanced standard format of criminaln magitrate instrument reasoning. |
