| 摘 要： | “非典”疫情应定性为不可抗力 ,但“非典”疫情的影响应具体分析 ,当事人不能据此全部免责。适用不可抗力制度免责应具备四个条件。充分认识不可抗力制度的实质并对当前法律制度进行深刻的反思 ,有助于准确把握不可抗力的内涵 ,正确解决实践中出现的此类问题
