| 摘 要： | 韩非子与马基雅维里在以"人性恶"构建其法律思想理论基础上,在拥护君主专制,主张强力以及采取法、术、势相结合的方式进行统治等方面具有相同之处;但二者在对待人民力量的重视程度,对人性的认识以及在集权方式等方面却有不同。分析比较二者法治思想的异同,对我国法治建设中推进依法治国,加强"官德"建设等具有重要的意义。

| Abstract: | There are similarities as constructing legal thoughts based on people cachexia,supporting monarchy,standing firm power,and ruling the country by combining the operation,potential and law between Machiavelli's Thought of Ruling the Country by Law and that of Hanfeizi.But there are such differences as attention to the people power,recognition to human nature and the way of centralization.It is significant to analyze and compare the above two in advancing ruling the country by law and strengthening official morality in constructing our legal system. |
