| 摘 要： | 期待可能性理论产生于20世纪初期的德国,经过一百多年的发展。在德国、日本的刑法学界已得到了相当程度的确立。我国理论界近年来虽已加强了对期待可能性理论的学习和研究,但尚显不足,有必要展开探讨。
