警察出庭作证问题研究

近年来,警察出庭作证成为各方关注的热点之一。首先,从比较法的角度分析了两大法系刑事诉讼中警察出庭作证的异同点及其成因,澄清了媒体呼吁警察出庭作证常态化的误区,其次分析了我国警察出庭作证现状及确立警察出庭作证之必要性,又次从理论和实践两个层面分析了警察出庭作证必须克服的障碍,并在此基础上规划了警察出庭作证范围“度”的把握,最后设计了警察出庭作证的制度保障措施。

Researches on the Policeman Serving as Witness at Court

In recent years, policeman serving as witness at court becomes a hot topic. First, this paper compares the criminal procedure of the two systems of law with focuses on differences and causes of the policeman serving as witness. Then, the status quo and necessity of policeman serving as witness in Chinese court ake analyzed. Finally, obstacles for policeman serving as witness in court and the relevant protective measures are pointed out.
