罪犯医疗保健标准初探

为罪犯提供医疗保健是监狱的法律责任,体现了国家对罪犯人权的尊重和保障。然而,监狱应该为罪犯提供什么样的医疗保健,法律规定却语焉不详。监狱没有一个可操作的标准,在实际工作中就会承担一些不该承担的责任和风险。制定罪犯医疗保健标准要从实际出发,现阶段我们只能为罪犯提供基本的医疗保健。在完善我国的监狱立法之前,根据监狱法的规定,监狱可以先制定一个合理的标准。

Providing the medical health care for the criminals is the jail legal liability,which manifest the national respect to the criminal human rights.However,what type of the medical care the jail should provide for the criminals? The legal rule is actually insufficiently detailed.The jail has no standards to operate by,they will undertake the responsibility and the risk in the practical work which should not be undertaken.Formulating the criminal medical service standard have to embark from the reality,at the present stage,we can only provide the basic medical care for the criminals.Before the jail legislation comes out,the jail may first formulate reasonable standards according to the jail law.
